In India, CBD-dominant, leaf-derived or hemp-compliant products are increasingly available under AYUSH/FSSAI frameworks, while high-THC “ganja/charas” remains prohibited under the NDPS Act, with only narrow exceptions for bhang and licensed medical use.

CBD and THC in India: Why the Difference Matters Here

India’s cannabis law hinges on plant part and THC content, not just the molecule name. The Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985 defines “cannabis (hemp)” as charas, ganja, and mixtures, but expressly excludes seeds and leaves. This means leaf-derived CBD sold under an Ayurvedic/AYUSH licence can fall outside the NDPS “cannabis” definition, whereas flowering-top or resin-derived CBD/THC is controlled. At the same time, industrial hemp cultivation is permitted in some states, and FSSAI sets ceilings for hemp-seed foods. Practically, compliant CBD products are far more accessible than THC-dominant options for most Indian users. 

What Is CBD (Cannabidiol)?

CBD is a non-intoxicating phytocannabinoid that does not produce a “high.” Pharmacologically, CBD has a multimodal profile: it acts as a negative allosteric modulator at CB1, shows CB2 inverse agonism/antagonism, inhibits anandamide inactivation, and engages 5-HT1A, TRP channels, GPR55, and PPAR-γ. Clinically, the strongest evidence supports purified CBD for certain epilepsies (e.g., Dravet, Lennox–Gastaut), with smaller trials suggesting anxiolytic effects at intermediate oral doses in an inverted-U dose–response. In India, CBD is commonly marketed as oils, tinctures, topicals, and gummies under AYUSH or as hemp-derived supplements, provided they meet THC thresholds and licensing norms. 

What Is THC (Tetrahydrocannabinol)?

THC is the primary psychoactive cannabinoid in cannabis, acting mainly as a partial agonist at CB1 and CB2 receptors to produce euphoria, appetite stimulation, antiemetic, and analgesic effects. However, THC can be anxiogenic—especially at higher doses or in inexperienced users—and chronic high-potency use is associated with increased anxiety and cognitive/psychiatric risks. In India, recreational THC (ganja/charas) is prohibited nationwide under the NDPS Act; limited legal pathways exist for bhang (leaf preparations) in some states and for licensed medical products, but high-THC retail remains restricted.
